Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Linkly (“Linkly”, “we”, “us”, “our”) and govern your access to and use of Linkly's services — our websites, apps, and related features (together, the “Service”). By creating an account, or by accessing or using any part of the Service, you accept these Terms in full. If you do not accept them, do not use the Service.

PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE A BROAD LICENSE TO THE CONTENT YOU POST (§4), SWEEPING DISCLAIMERS OF WARRANTIES (§16), A STRICT LIMITATION OF OUR LIABILITY TO THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS (§17), YOUR OBLIGATION TO INDEMNIFY US (§18), A CLASS-ACTION WAIVER AND A ONE-YEAR TIME BAR ON CLAIMS (§19).

1. Who may use the Service

You must be at least 13 years old to use the Service. Content marked as sensitive (“NSFW”) is strictly limited to users who are at least 18 years old (§7). By using the Service you represent that you meet these requirements, that you are legally capable of entering into this agreement, and that you are not barred from using the Service under any applicable law. You may use the Service only for yourself, on one account, under your real control. We may refuse, suspend, or reclaim any account or username at any time, for any reason, including usernames that are inactive, misleading, or infringing, or where we determine a username should be made available to another user.

2. The Service

Linkly lets you collect, curate, and share links: link collections, link-in-bio pages (“biolinks”), shortened links, synced browser bookmarks, comments, likes, follows, and visit analytics (“Insights”). The Service is a conduit for links and user content. We do not author, verify, endorse, or control the destinations of any link on the Service, and we owe you no duty to do so. The Service may include automated accounts and content created or curated with the help of artificial intelligence. We may add, change, suspend, or discontinue any feature at any time without notice or liability.

3. Your account

You are responsible for everything that happens under your account, whether or not you authorized it. Keep your credentials secret and your account secure. We are not liable for any loss arising from unauthorized use of your account. Information you give us must be accurate and kept current. Accounts are personal and non-transferable; you may not sell, rent, or share account access.

4. Your content and the license you grant us

You retain ownership of the content you submit — collections, biolinks, titles, notes, descriptions, comments, images, avatars, covers, and any other material (“Your Content”). By submitting Your Content you grant us a worldwide, non-exclusive, royalty-free, fully paid, transferable and sublicensable license to host, store, cache, use, copy, reproduce, process, adapt, modify, translate, publish, publicly display, publicly perform, distribute, and create derivative works of Your Content, in any media or method now known or later developed, for the purposes of operating, providing, promoting, marketing, securing, and improving the Service — including generating previews and link metadata; distributing Your Content through feeds, search, and discovery surfaces; displaying it alongside advertising; using it in our own marketing in any medium; and analyzing it to train and improve our internal systems, including recommendation, ranking, safety, and machine-learning systems. This license includes the use of your username, display name, avatar, and likeness as they appear in Your Content and on your profile. You receive no compensation for any of this: your use of the Service is the sole and sufficient consideration. The license continues until Your Content is deleted from our systems, except that (a) content already shared, reposted, cached, or exported by others or by third-party services may persist, and (b) we may retain copies in backups and logs for a commercially reasonable period.

You represent and warrant that you own or have every right, license, consent, and permission needed for Your Content and its grant to us, and that Your Content does not and will not infringe or violate the rights of any person or any law. If you send us feedback or suggestions, we may use them freely, forever, without restriction, attribution, or payment.

5. Responsibility for content

All content on the Service — every link, page, collection, comment, image, and profile — is the sole responsibility of the person who posted it. We do not and cannot monitor, review, or verify content, and we assume no obligation to do so. You may encounter content that is offensive, inaccurate, misleading, mislabeled, harmful, or otherwise objectionable; you use the Service, and rely on anything found on it, entirely at your own risk. We may remove, hide, restrict, demote, reclassify, or add warnings to any content at any time, with or without notice, for any reason or no reason, and we are not liable for doing so — or for declining to do so.

6. Acceptable use

You must not, and must not attempt to:

  • post, link to, or facilitate content that is illegal anywhere it is accessible — including child sexual abuse material, non-consensual intimate imagery, extreme pornography, terrorism content, or content that infringes intellectual-property rights;
  • harass, threaten, defame, dox, impersonate, or defraud anyone;
  • distribute malware, phishing pages, or deceptive redirects, including through short links;
  • spam, artificially inflate engagement, or manipulate Insights;
  • scrape, crawl, harvest, or bulk-download any part of the Service or its data without our prior written consent, or access the Service by any automated means other than our published interfaces;
  • probe, bypass, or interfere with security, rate limits, authentication, or any access or regional restriction (including the regional restrictions in §7);
  • reverse engineer, decompile, or copy the Service or resell access to it.

We may investigate any suspected violation and may report anything we consider unlawful to authorities, and you authorize us to share related information with them.

7. Sensitive (NSFW) content — 18+ and regional limits

  • 18+ only. Sensitive content is available only to users who have declared they are at least 18 and have enabled it in settings. You must not enable it if you are under 18, and you must not help anyone under 18 encounter it.
  • You must label. If any collection or page of yours contains nudity, sexual content, or other adult material, you are required to mark it NSFW. Mislabeling is a material breach of these Terms and grounds for immediate removal and termination. We may label, relabel, or reclassify anything at our sole discretion.
  • Hosting limits. Sexually explicit media may not be used in surfaces intended for general audiences (such as avatars and cover images), as determined by us.
  • Regional restrictions. Some jurisdictions (for example the United Kingdom under the Online Safety Act 2023) legally restrict access to adult content without age assurance. We restrict or disable sensitive content in certain regions, based on where you appear to be accessing the Service from, and we may change the restricted regions at any time. You must not circumvent or attempt to circumvent these restrictions (including via VPNs or proxies), and we provide no support, refund, or compensation because content is unavailable in your region.
  • No monetization of adult content. You may not collect payment through the Service for access to adult content.

8. Third-party links and services

The Service exists to point to third-party websites, apps, and services. We have no control over them, we do not endorse them, and we accept no responsibility whatsoever for their content, products, policies, security, or conduct — even where our features (previews, metadata, favicons, embedded content) make a destination look native to Linkly. When you follow a link, you leave our responsibility entirely. Any dealings you have with third parties, including creators you discover through the Service, are solely between you and them.

9. Short links

Short links redirect to destinations chosen by their creators. We may scan, flag, disable, or delete any short link at any time, including links we suspect of abuse, and we may show interstitial warnings. We do not guarantee that any short link will keep working, and we are not responsible for where a short link takes you.

10. Insights

Insights give creators aggregated statistics about visits to their content — counts, referrers, device categories, and approximate visitor locations — that do not identify individual visitors. By visiting public content you consent to this measurement. Insights are estimates, provided for information only; we do not warrant their accuracy and you must not rely on them for any commercial decision.

11. Advertising

In exchange for free access to the Service, you agree that we and our partners may place advertising, promotional, and sponsored content anywhere on the Service — including on, next to, or within your collections, biolink pages, and feeds — without notice, opt-out, or compensation to you.

12. Intellectual property; copyright complaints

The Service, its software, design, brand, and everything in it other than Your Content is ours or our licensors' and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service as intended and nothing more. If you believe content on the Service infringes your copyright, report it via the in-product reporting feature or our contact form with the identification of the work, the infringing URL, your contact details, and a good-faith statement. We may remove content and terminate repeat infringers at our discretion.

13. Reporting and moderation

Users can report content and accounts. Reports do not obligate us to act, and we do not promise any response time or outcome. Moderation decisions — including removing, restricting, or limiting the visibility of content or accounts, and declining to act — are made at our sole discretion and are final. We owe no duty to you to moderate, or to explain moderation of, anyone's content, including yours.

14. Termination

You may stop using the Service and delete your account at any time in settings. We may suspend or terminate your account, or any part of the Service, at any time, with or without notice, for any reason or no reason at our sole convenience — including violation of these Terms, legal risk to us, prolonged inactivity, or discontinuation of the Service. On termination we may delete Your Content and your data, and we are not responsible for any loss of content, followers, statistics, or anything else. Sections 4, 5, 8, and 15–22 survive termination.

15. Changes to the Service and these Terms

We may revise these Terms at any time by posting the revised version at this page with an updated date. For material changes we will make reasonable efforts to give notice, but we are not obligated to notify you individually. Your continued use of the Service after a revision takes effect is your acceptance of it. If you do not agree, your sole remedy is to stop using the Service.

16. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT ANY CONTENT, LINK, INSIGHT, OR NOTIFICATION IS ACCURATE OR RELIABLE; THAT DEFECTS WILL BE CORRECTED; OR THAT YOUR CONTENT OR DATA WILL NOT BE LOST, CORRUPTED, DELETED, OR DISCLOSED. WE ARE NOT RESPONSIBLE OR LIABLE FOR THE CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY, ON OR OFF THE SERVICE, INCLUDING OFFENSIVE, DEFAMATORY, ILLEGAL, OR OTHERWISE OBJECTIONABLE CONTENT. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) IN NO EVENT WILL LINKLY, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, SUPPLIERS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, CONTENT, FOLLOWERS, OR REPUTATION, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. IF ANY PART OF THIS SECTION IS FOUND UNENFORCEABLE, OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING FOR FRAUD OR FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

18. Indemnification

To the maximum extent permitted by law, you agree to defend (at our request), indemnify, and hold harmless Linkly and its owners, officers, employees, contractors, and partners from and against any claims, liabilities, damages, losses, fines, and expenses — including reasonable legal fees — arising out of or related to: (a) Your Content; (b) your use or misuse of the Service; (c) your breach of these Terms or of any law or third-party right, including mislabeling sensitive content or misrepresenting your age; or (d) any dispute between you and any other user or third party. We may assume the exclusive defense of any matter subject to indemnification, in which case you will cooperate fully. You will not settle any such claim without our prior written consent.

19. Disputes, governing law, class-action waiver

These Terms and any dispute arising from them or the Service are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, and you and we submit to the exclusive jurisdiction of the courts and enforcement offices of Istanbul (Çağlayan), Türkiye. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND WE EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING; ALL CLAIMS MUST BE BROUGHT IN THE PARTY'S INDIVIDUAL CAPACITY. ANY CLAIM RELATING TO THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER IT AROSE; OTHERWISE IT IS PERMANENTLY BARRED. If you are a consumer in the European Economic Area or the United Kingdom, the mandatory consumer protections of your country of residence remain unaffected and you may also bring proceedings in your local courts.

20. Privacy

Our Privacy Policy and Cookie Policy describe what we collect and how we use it. They form part of these Terms.

21. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of hosting, network, or third-party providers, attacks, natural disasters, war, labor disputes, or acts of government.

22. Everything else

These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and us about the Service and supersede all prior agreements. If any provision is unenforceable, it will be limited or severed and the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them freely. No agency, partnership, or employment relationship is created.
